Aam Aadmi Party to contest assembly by-elections in Gujarat

Ahmedabad: Aam Aadmi Party's (AAP) Gujarat unit said here today that it has decided to field its candidates for seven Assembly seats where by-polls will be held alongwith the Lok Sabha elections.

"AAP will field its contestants from seven Assembly seats during the upcoming elections," said AAP Gujarat's spokesperson Harshil Nayak said.

"We will field contestants from Rapar and Abdasa of Kutch district, Lathi of Amreli district, Visavadar and Somnath of Junagadh district, Himmatnagar of Sabarkantha
district, as well as Mandvi assembly seat in Surat district," he said.

"By-polls in most of the seats have to be conducted as Congress MLAs from those constituencies joined the BJP, while Visavadar seat of Junagadh has been vacated by senior leader and former Gujarat chief minister Keshubhai Patel as he left active politics," he said.

AAP has also alleged that Keshubhai Patel has vacated the seat keeping his son Bharat's political career in mind and that his son returned to the BJP in February.

"Assembly by-elections will be held along with Lok Sabha elections on April 30. When both the parties field their candidates, we have also decided to do so," AAP's state convener Sukhdev Patel told PTI.

"We do not want to let voters remain confused between BJP or Congress. So we are giving them the option of AAP," Patel said.

"BJP committed an unethical blunder by taking Congress MLAs who were sent to the Assembly by the people and we are committed to expose these MLAs," he said.

"The next Assembly election is in 2017 and this is prior preparedness, so that we can also show our strength and they (BJP and Congress) will also realise our strength," Patel said.

"As soon as people send their nominations to the Delhi leadership and party leaders select candidates, we will declare candidates for the Gujart Assembly by-elections," Patel said.

Gujarat BJP wants Modi to fight from state, keeps Advani in Gandhinagar

New Delhi: BJP prime ministerial candidate Narendra Modi will fight the forthcoming Lok Sabha elections from two seats. While the party has already announced Varanasi to be one of the seats where Modi will contest from, the BJP Gujarat unit after a meeting today also decided that the state chief minister may fight from Ahmedabad East, Vadodara or a surprise third seat.

Party veteran LK Advani will seek re-election from Gandhinagar and not from Bhopal, as the grapevine was doing the rounds. It is now possible that Subramanian Swamy, whose name was being considered from New Delhi could ultimately go to Bhopal.

These details are likely to be finalised in the Central Election Committee meeting on Wednesday.

Earlier in the day, it was decided that the state party unit will strongly recommend that Modi should also contest from his home state too as it is the "wish and demand of people of Gujarat as well as party workers". The decision to make these recommendations to the party's central leadership was taken by the state parliamentary board, which met in Gandhinagar today at Modi's residence.

"Out of the 26 seats of the state, we have finalised panel of three names (each) for 25 seats, barring only one constituency of Gandhinagar. On the Gandhinagar seat we have recommended party leader L K Advaniji," state BJP general secretary Vijay Rupani. There were speculations that BJP may field Modi from Gandhinagar and like senior leader Murli Manohar Joshi, Advani would also be told the fight elections from another seat. Advani had earlier staked his claim for the seat, from where he has successfully contested and won five times.


Odisha polls: Cong comes out with first list of 118 candidates

New Delhi: Congress today released first list of 118 candidates for the Assembly polls in Odisha and several senior leaders including PCC chief Jaydev Jena, Lalatendu B Mohapatra, Prasad Harichandan and Sarat Rout have found place.

The state will have the Assembly polls along with the General elections in two phases, on April 10 and 17. Congress candidate Saroj Padhi will fight from Aska, Chief Minister Naveen Patnaik constituency.

Congress, which is out of power for the last 15 years in Odisha, is facing an uphill task as party stalwart and leader of opposition in the state Assembly Bhupinder Singh defected to the ruling BJD recently.

The party had won 27 of the total 147 seats in the last Assembly elections. In the first list for 118 constituencies, Jena would be contesting from his home turf Anandpur while Mohapatra will be fighting to retain the Brahmagiri Assembly seat.

Sarat Rout will contest from Sukinda while Harichandan will fight the elections from Satyabadi (Puri).

In coastal constituencies where BJD is on a strong wicket, Congress has decided to field Chiranjeev Biswal from the key Jagatsingpur constituency, Suresh Kumar Mohapatra from Choudwar, Chandra Sekhar Samal from Cuttack Sadar and Mohammad Mouqim from Cuttack-Barabati.

In Western Odisha, considered a traditional Congress stronghold, the party would be fielding Dushmanta Naik from Bhawanipatna, Narasinga Mishra from Balangir and Naba Kishore Das from the industrial town of Jharsuguda.

Pravat Mohapatra would be contesting from the steel city of Rourkela.

PIL seeking review of allotment of permanent symbols to parties dismissed

Chennai: Madras High Court today dismissed a PIL seeking a direction to ECI to review its decision of allotting permanent symbols to political parties.

The petition was filed by "Traffic" Ramaswamy, a social activist, seeking a direction to the ECI to review its decision of allotting permanent symbols to the national and state political parties.

"The petitioner without waiting for a reasonable time, has chosen to file this petition. This is nothing but misuse of judicial process," the First Bench comprising Acting Chief Justice Sathish K Agnihotri and Justice M M Sunderesh said.

Ramaswamy submitted that AIADMK General Secretary and Tamil Nadu Chief Minister Jayalalithaa is misusing the official powers by introducing party symbol in government schemes with a view that the symbols permanently allotted to it cannot be changed.

While mentioning about several projects which were named as "AMMA", he wondered how the schemes and projects of the State Government could be used for election propaganda.

While independent candidates were allotted new symbols, national and state level parties were given permanent symbols for years together, he submitted.

Till date, rules regarding symbol allocation were not changed, he submitted.
The court, quoting a judgment of a seven member constitution bench of the Supreme Court, said "in case of statutory representation or appeal, the minimum period required for response is three to six months.

Even if the period is not prescribed, those authorities should be given a breathing time, that is reasonable time, to consider and pass orders on the representations made which is going to have a far reaching effect in the election system".

Stating that the petitioner did not wait "for a reasonable period" of time before filing the plea, the court dismissed the PIL saying, "This is nothing but misuse of judicial process," and imposed a fine of Rs 5,000 on Ramaswamy. Later, on a request from Ramaswamy, the fine was cancelled by the Bench.

Total domination: BJP shrinks as Modi grows

With so much dirty linen being washed in public the BJP's claims of total consensus on all decisions over the past few weeks hold no water. RSS supremo Mohan Bhagwat warning party workers against just chanting the NaMo mantra and leaders of L K Advani, Murli Manohar Joshi and Sushma Swaraj's vintage resenting the party's rapid transformation into a one-man entity point to growing unease.

The RSS blank cheque to Modi with clear instructions to get the desired results leaves him free to try all machinations in Bihar, Uttar Pradesh and Madhya Pradesh as he did in Gujarat.

The Sangh has been preparing the ground for such transformation for nearly five years. An RSS ideologue had opened up in early 2010 — after the NDA's abortive attempt to wrest power under Advani —to say that Sangh wanted the geriatric leaders to hang up their prime ministerial ambitions and take up advisory roles. Advani overlooked the signals.

Ironically he was made to wait for Modi's verdict on his candidature from Gandhinagar till late on Tuesday. What would be his role in the event of the NDA's victory? Will he be serving under Modi?

The entire exercise of seat distribution reveals complete control of Modi along with party chief Rajnath Singh and vice-president Arun Jaitley. Interestingly the Singh- Jaitley confrontation had cost the BJP dear during the previous General elections. Images of Atal-Advani era are being scrubbed off swift and hard. The two leaders no longer greet you from the party bill-boards. Modi is just the man of the moment.

Is the Modi wave strong enough not to brook dissent among scorned party veterans? If that is so why are senior BJP leaders scampering for safe seats?

Even Modi has kept his Ahmedabad substratum secured while taking a plunge in Varanasi.

Arun Jaitley elbowed out Navjot Sidhu to stake claim for Amritsar on realising that he needed to do more than just pull strings from backstage as he has done for 25 years now. Sidhu, for whom the Amritsar electorate had issued a 'missing' notice, has refused to contest from anywhere else. He would have in any case struggled to win a third term after falling out with Akali stalwart Parkash Singh Badal. Jaitley sought to placate Sidhu saying he was "bowled over" by grace and dignity shown by him.

The party is making compromises with people it had discarded for certain principles. In Bihar, another state where the party is playing for high stakes, the tie up with Ramvilas Paswan has changed the caste equations. The BJP vice-president C P Thakur, deputy speaker in the Bihar assembly Amrendra Pratap Singh, as well as Giriraj Singh and Ashwini Kumar Choubey, all representing upper caste interests, have clearly indicated their opposition to alliance with Paswan. Modi has overruled the protests apparently in the hope that the upper caste voters have nowhere to go accept BJP.

The RJD leader Laloo Prasad Yadav whom Paswan ditched to join hands with Modi sees an unexpected silver line here. He says the Bihari will reject Modi-- and therefore Paswan too—for the BJP's recent alliance with Raj Thackray in Mumbai. This should alert Biharis who have been humiliated in Mumbai, he says. But the Modi counter comes in the form of alliance with Ramkripal Yadav, a Laloo loyalist of 25 years' vintage. Ramkripal is perhaps even a better catch than Paswan as he hits Laloo where it hurts most. Ramkripal's departure exposes Laloo's weakness for family ties which he has put ahead of party's interests. Yadav's have now three leaders to choose from. Sharad Yadav of the JD(U), Ramkripal of BJP and Laloo Yadav. With Laloo's Muslim-Yadav (MY) formula gone through a shredder the question now is whether BJP would still remain untouchable to the Muslims?

Even in Madhya Pradesh the pendulum seems to have swung the other way since the assembly elections. In the initial stages of the assembly campaign Chief Minister Shivraj Singh Chohan wasn't sure of Modi's status and stature in the party's scheme. His road shows through the state were carried out without Modi's images on promotional material. Even the Congress had conceded that Chief Minister Shivraj Singh Chouhan was mainly responsible for the ruling party's sterling performance in the November elections, though Modi made more than 15 sorties in the state. Three months down the line the party posters have banished Chouhan. As is his wont Narendra Modi stares down most hoardings in first person singular number in Madhya Pradesh. Whether this cuts ice with a sizeable Muslim electorate in the state is to be seen.

The other heartland state Rajasthan, however, looks completely at ease with Modi.


Fact-check: Here’s why Adani may not have received a sweetheart deal from Modi

Earlier this month, Forbes Asia published a report hinting at alleged crony capitalism practised by Gujarat Chief Minister (and BJP's prime ministerial candidate) Narendra Modi. That it received wide publicity was obvious given that Modi and his governance model are the central focus in the upcoming 2014 Lok Sabha elections.

Indeed, if Modi is staking a claim to ask India's vast electorate to vote for him and his party this summer on the basis of his governance record, strict scrutiny on that record is obvious and must be welcomed.

However, the report scrutinising his record contains factual inaccuracies and half-truths. Among other things, the report claims that the Gujarat government gave the land seized from the village to Adani for a song - and that the Gujarat high court ordered the state to give the villagers alternate land for grazing. The facts, however, are quite different.

On the Gujarat HC "ordering" Gujarat government and Adani

To buttress one of the themes of the report, ie, that Adani Group has been the recipient of the Modi government's generosity, it talks about a case filed in the Gujarat High Court by village residents of Zarpara, a village in Kutch where the Mundra port has been set up, when gauchar (grazing) land was allotted to the Adani Group by the government of Gujarat (GoG). The report says, "the court in the summer of 2011 ordered the government and Adani to replace that land for the villagers but nothing has happened so far."

The fact is that the high court never ordered GoG or Adani to replace that land. In fact, the petition filed by residents was not even aimed at requesting the court to issue any such order. The court merely recommended (not "ordered") GoG to examine whether an equivalent area out of wasteland available with GoG could be allotted to the village.

Check this excerpt from the Gujarat HC judgment dated 22.06.2011. The case number is SCA 7254/2008

The reason this is vital to point this out is to correct a likely impression readers may gather that GoG ignored the high court's order for Adani's benefit. Not only did the Gujarat High Court reject this challenge by the residents, even the Supreme Court rejected an appeal preferred by the residents via an order dated 30 October 2012 [SLP (Civil) 26888/2011].

Surprisingly, the Forbes report did not deem it necessary to mention that.

Law and policy regarding grazing land

It is useful to understand the totality of the law and GoG policy pertaining to allotment of grazing land, particularly in view of what the Forbes report states. The relevant points that emerge from a combined reading of Section 108 of the Gujarat Panchayat Act, 1993 (GPA), GoG resolutions (one, dated 30 December 1988 and another dated 27 January 1999) and the Supreme Court's pronouncements are as under:

  • The grazing land allotted to Adani Group in Zarpara village is one which was originally land belonging to GoG vested by it in the village panchayat for grazing use. Therefore, if that grazing land has to be allotted, Section 108(4) of GPA makes it lawful for GoG to 'resume' such land (ie, take it back) at any time, if required, for a public purpose.
  • Notably, the Supreme Court has held that the setting up of a Special Economic Zone is "public purpose" since it benefits not only the village and adjoining areas but even the state and the country in terms of the business opportunities it generates [Shah Kantilal Depar v RIL, 2006].
  • Further, the Supreme Court has clearly held that, if the land in question is one covered by Section 108(4) of the GPA, it is not obligatory for the state government to obtain consent of, or even consult, village residents or the panchayat. This is because the land in question belongs to the state government and is vested in the village panchayat with a legal understanding that the land can be resumed by the state government at any time [Panchayat Varga Shramjivi Samudaik Sahakari Khedut Co-op Society Ltd. vs Haribhai Mevabhai, 1996].
  • The GoG resolution dated 30 December 1998 requires that a certain ratio (grazing land:cattle) be maintained as far as possible. That said, if GoG has to take over grazing land for a public purpose, it can do so in exceptional cases even if grazing land is not in excess. The resolution further states that, if there is opposition from local self-government bodies, then, as far as possible, the procedure for the resumption of such land should be avoided unless opposition is found to be baseless.
  • It is useful to note here that, though the resolution asks GoG to be mindful of opposition from local self-bodies, the high court and the Supreme Court have confirmed that these are just guidelines and the law does not mandate the government to hold consultations with the village panchayat in cases of land covered by s. 108(4) of GPA.
  • Yet, consent of village panchayat was voluntarily taken before allotting the grazing land at Zarpara village to Adani and the panchayat did give consent. Three years later, the newly elected panchayat did oppose the allotment, but the high court rejected that.
  • Further, under GoG resolution dated 27 January 1999, every time a business is allotted grazing land, the state government must collect 30 percent premium in addition to the price of the land. GoG must, if possible, allot similar area of land out of government wasteland to village panchayats for grazing. Notably, however, if such wasteland is not available, the 30 percent premium should be given to the village panchayat as compensation.

(This is one more reason why the Forbes report is wrong about the Gujarat HC "ordering" GoG and Adani to replace the land allotted with more land. It is not the only option. In fact, the required 30 percent premium was already collected by GoG from the Adani Group back in 2007 when the land was allotted. It was only a question of GoG handing over that premium to the village panchayat.)

To sum up, the law does not mandate that grazing land can be allotted only if it is in excess of the ratio nor does it mandate permission of the village chief. The Forbes report, however, rather confidently states that under the law grazing land can be used for something else only if it's "in excess" and that, even then, the village chief has to give permission to take the land.

Not only is this exposition of the law utterly simplistic, it is also inaccurate.

Environmental clearance to Adani SEZ

The Forbes report also alludes to the lack of environmental clearance to the Adani SEZ (the ministry of environment and forests, MoEF) not having taken a decision for almost 18 months) and ends by stating that the fate of this project will likely be decided by the government in power next which could easily be a Modi-led government. Is this an insinuation that Modi, as PM, may easily grant clearance to his friend Adani? I will leave it to the readers.

At the outset, it must be stated that the Adani Group was ill-informed to commence construction in the SEZ without obtaining prior environmental clearance. That said, the Expert Appraisal Committee of the MoEF recommended environmental clearance to the SEZ way back in 2012 after which the MoEF is supposed to take a final call.

Notably, under Clause 8(iii) of the EIA (Environment Impact Assessment) Notification 2006, if the MoEF does not decide within 45 days of the EAC recommending grant of clearance, that recommendation is deemed to be the decision of MoEF. Therefore, legally, as of today, Adani Group has clearance for the SEZ.

What made the high court order a stay on further construction within the SEZ area is that construction had commenced prior to the deemed clearance, which made it unlawful. Deemed clearance only applied if construction was commenced after it was obtained. Therefore, the deemed clearance could not cure the illegality committed prior to obtaining it.

True, there continue to remain concerns about environmental violations by the group. A committee headed by Sunita Narain, constituted by MoEF, has recommended the imposition of penalties for violations, particularly around the North port area. But even the Narain committee recognises that large-scale development has been taken undertaken and it won't be prudent to halt or cease operations in areas other than the North port.

Therefore, instead of obsessing over what Modi-led government will do, what's truly condemnable is that the UPA Government (the MoEF) has been plagued with utter inaction. Worse, when the Gujarat high court was hearing this matter, it did not even bother to file a reply, as is evident from the insert below.

Due to this inaction, the Gujarat high court, in its judgment in January this year, ordered MoEF to take a decision within 30 days of the date of the judgment "without fail". The UPA sat on the file and, soon after the 30-day period, the Model Code of Conduct was imposed.

This background is vital to understand the insinuation made in the Forbes report. If a Modi-led government takes a decision as per the Narain Committee recommendations, would that government do so because Adani is Modi's buddy? Or, would it do so because the EAC has already recommended granting clearance, the Narain Committee does not recommend cancelling clearance for the entire SEZ and MoEF under UPA has been sitting on the file since 2012?

On land allotment rates

The Forbes report makes much of GoG's "bent" towards big businesses by juxtaposing the rate at which Adani got land from the GoG and the rate at which it sublets to businesses. It also states that none of the other companies in Gujarat "have received the kind of largesse on land rates as Adani."

First, the GoG policy for determining land rates for industrial purposes.

Under GoG resolution dated 15 January 1998 and other circulars, the process is as under:

1)  Collector of the area typically receives application for allotment of government land. Collector informs Deputy Town Planner (DTP) of the location and condition of the land. The price of the land is determined at this initial level by the Collector's office.

2)  The DTP visits the land and (i) takes cognisance of sales that took place in adjoining areas in the past five years; and (ii) conducts an assessment of the technical aspects and determines a price at this level. In a sense, this entails considering the market price at the relevant time.

3)  If the price is below Rs 15 lakh, the collector has the authority to allot the land and prescribe conditions.

4) If price is above Rs 15 lakh, a file is put before a District Valuation Committee (DVC - consisting of Collector and two other officials) which evaluates the file and pricing at the aforementioned levels.

5) If the DVC values land at a price greater than Rs 50 lakh, the entire file is sent to the Revenue Department which, in turn, sends file to the Chief Town Planner who evaluates it and suggests increase/decrease in price, if any.

6) The file is then presented before the State Pricing Committee (SPC - consisting of higher level bureaucrats of the revenue department, Urban Development & Urban Housing Department and the Finance Department). If the SPC also determines the value of the land to be above Rs 50 lakh, the file is sent to the state cabinet for a final decision.

In fact, in one instance, although the SPC determined rates of two of the three locations where Adani applied for tracts of land as Rs 4.25 and Rs 6 per square metre, the Council of Ministers (the one headed by Modi) determined that the price of those tracts (rather large) would be Rs 25 per square metre since that was the rate the SPC arrived at for the third location.

(Disclosure: The author represented Gujarat Government in the Justice MB Shah Commission of Inquiry where these allegations and GoG resolutions were addressed threadbare.)

Instead of making sweeping statements that none of the other companies received the kind of largesse on land rates as Adani, it may be useful for Forbes to dig out actual examples where this procedure was not followed by GoG.

Lastly, it is useful to bear in mind that this wasn't the case of the Adani Group getting land at rate x, sitting on it, doing no improvements and then leasing it to Y for a handsome profit (10x or 20x). Adani wasn't merely flipping land. The group constructed a port which entails heavy capital expenditure and huge risks. Moreover, any study of the economic history of India will indicate how critical a port is for the development of that region and state.

Since Forbes highlights the profit Adani made by subleasing land to Indian Oil, let us take the example of why Indian Oil set up shop in Adani port at a high sublease price. Back in 2002, it was particularly attracted to setting up its business of handling crude oil at Mundra because of, among other things, the single point mooring (SPM) system Mundra port provided. That SPM system offers significant marine freight savings.

Adani Group offered to sublet at an amount based on what it estimated takers would be willing to pay. IOC could have refused to agree to those terms. In that case, Adani wouldn't have got business from IOC. It isn't as if there weren't other ports in India where IOC couldn't set up shop. Indeed, Adani port wouldn't have got business from anyone if all found the subletting rates too high on a cost-benefit analysis. But, IOC freely made a business decision looking at what benefits it would get as a company. So do many other entities.

What happens when a state has a port with competitive facilities? Trade and business increases. Both GoG and government of India (GoI) earn several types of revenues in the form of taxes and charges even if it offers concessions on some of them. That revenue can give governments the cash cushion to spend on welfare programmes to bridge the gap even further. Yes, Adani earns too and he has every right to.

Has Forbes even bothered to see what revenues GoG and GoI have got from the entire business which is generated in Mundra? Juxtaposing two rates at separate times offering different things under different conditions is not right.

The purpose of this column is not to say that Modi and Adani are beyond criticism. Certainly not. But it seems that the author has not read the very court judgment quoted in the report or studied the law to support its criticism. The report is thus misleading.

Am not going to Varanasi to contest poll but to defeat Modi: Kejriwal

New Delhi: Firing a fresh salvo at Narendra Modi, AAP National Convener Arvind Kejriwal today said his decision to enter the electoral fray from Varanasi was not a "symbolic gesture" but to defeat the BJP's Prime Ministerial candidate.

"Narendra Modi has announced that he will contest from Varanasi. So even I am going to Varanasi. We will ask people there on whether I should contest against Modi. If they say yes then I am ready to contest", he said.

"I read in newspapers and websites and that this is a symbolic fight. I must tell you that we are going there not to contest elections, but to defeat Modi," Kejriwal said.

He was speaking at a conference "Roadmap to Indian Muslims", which was attended by AAP leaders like Prashant Bhushan and Gopal Rai. Kejriwal invited the crowd, mostly AAP supporters from the minority community, to join him in Varanasi.

As he announced that he was going to defeat Modi, the crowd roared, "Abhi to Sheila hari hain, Modi teri bari hain (Sheila has been defeated. Now it is Modi's time)"

He said that all parties indulged in corrupt practises and communal politics and this was led by the BJP and the Congress.

"All parties are the same. They indulge in corruption and communal politics, but leaders of all these parties are Congress and the BJP. It is important to defeat these parties...not on the basis of numbers, but by defeating their leaders. It is important to defeat Rahul Gandhi and Narendra Modi.

"We have sent Kumar Vishwas to Amethi and he has been stationed there for the past three months. He is being attacked on daily basis, but he is too strong to back out," he said.

Kejriwal added that if the BJP claims that voting for Modi would bring stability, then Prime Minister Manmohan Singh has given more stability.

"When I had been to Bangalore, people told me that I will eat into (BJP) votes. If Modi comes to power he will give stability. Then I said if you want stability then Dr Manmohan Singh has given maximum stability in last 10 years. People dont want stability, they want security and justice. Stability will come even if there are elections in a year or two. But these parties will spread corruption and communalism in the name of stability and this is unacceptable to us," he said.

EC warns internet firms against misuse by political parties

New Delhi: The Election Commission today warned internet companies against misuse of the popular platform by political parties during election campaign.

In a letter to Internet and Mobile Association of India and Chief Grievance Officers of all major social networking sites, the poll body has also asked the internet sites to inform the Commission regarding the expenditure incurred by political parties and candidates on political advertisements as and when demanded.

While the EC has already flagged the issue with political parties, it issued a directive to the Association saying that it was "very concerned" with the use of internet and social networking sites in election campaign.

The EC emphasised that no political advertisement should be accepted and displayed on internet and internet-based media without pre-certification.

It asked the internet-based media to carry out scrutiny to ensure that contents displayed by them during the electoral process is not unlawful, malicious or violative of the Model Code of Conduct which came into force on 5 March.

"In case any unlawful content coming to the notice of the election machinery and brought to the attention of internet-based media, the same would be removed forthwith," the EC said.

In October last, the EC had informed all political parties and Chief Electoral Officers that legal provisions relating to election campaigning apply to social media in the same manner in which they apply to any other form of election campaigning using any other media.

It had also asked candidates to ensure that the Commission is informed about their authentic social media accounts.

‘Concerned’ citizens for Modi: Attack on AAP is undemocratic

Twelve leading citizens of our nation are very "concerned". So much so that these worried gentlemen --  the likes of Gen SK Sinha, ex-director IB Ajit Doval, journalists MV Kamath and  MJ Akbar and former DG Punjab Police PC Dogra et al -- have issued a joint "appeal"  calling out unnamed new political parties for failing in their patriotic duty to bring down the UPA government.

"We are shocked that some new-fangled political groups are targeting the BJP more than the Congress, which has been in office for 10 years now," declares the alarmist statement which goes on at length about the perils posed by such Johnny-come-latelys:

The statement said the design of such parties was to promote cynicism in the public sphere, hamper the process of voter education, and create a space for themselves in the mass media.  "Ironically-or perhaps tellingly-these calculations can only benefit the Congress as it fights what would appear to be an impossible election," they said. 

Noting that the entire nation was awaiting change, they said yearning for development, good governance besides social and economic justice has reached a crescendo.  "In this situation, such attempts of new outfits and political platforms are hampering the cause of democracy, aspirations of the people and above all the national interest," the statement said, adding "rank opportunism and self-confessed anarchism" masquerading as a coherent political doctrine should not be allowed.

Add in all the talk about "fissiparious tendencies" these 'outfits' encourage in places like Kashmir, the statement roughly translates as thus: AAP's full-frontal assault on Modi is downright unpatriotic.  Arvind Kejriwal is not just a bad politician, he is a bad Indian.

Now, it is self--evident that the 12 signatories are supporters of Narendra Modi. And that's perfectly fine. In a democracy, citizens are free to make a pitch for their candidate of choice -- indeed, as a measure of their political engagement, they ought to be lauded for doing so. What is bizarre and unseemly, however, is the attempt to paint AAP's political strategy of attacking Modi as a threat to the nation.

AAP is doing what any party in its position would do, i.e. take on the front-runner. This is Elections 101. Candidates that lag behind gain traction by going negative on the guy up ahead. The aim is to draw blood, and slow him down. In US primary debates, for example, candidates will often unite and gang up against the front-runner. This isn't unpatriotic. It is just smart politics.

Arvind Kejriwal has been just as eager to go after the Congress party when it suited his strategic objectives -- as in the Delhi elections where Sheila Dikshit was the woman to beat. But in the Lok Sabha elections, it is a waste of his party's time and energy to parrot anti-UPA narratives in the midst of a huge anti-Congress wave. This time around, the Rahul Gandhi-led Congress isn't a serious contender for the gaddi. BJP is the party to beat, and more so Narendra Modi. And while Kejriwal does not seriously expect to become Prime Minister, he (and his party) stands a decent shot of gaining electoral ground by defining himself against Modi.

To demand that he abandon a sound and well-tested political strategy in the name of a misguided notion of "national interest" is a little hypocritical. And more so since, as The Telegraph reports, the "appeal" itself is a politically motivated attack aimed at defusing the threat AAP poses to Modi's ambitions:

Asked if the signatories' target was the Aam Aadmi Party, a BJP source said: "Without doubt."

"Look at the way Kejriwal is attacking only Modi and Gujarat," the source added. "He has shifted his goalpost from corruption, scams and the Congress to Modi and, in the process, is functioning like the Congress's surrogate."

Kejriwal, who recently criss-crossed Gujarat to try and puncture Modi's development and governance claims, has alleged that the chief minister has mollycoddled big industry at the cost of farmers against "considerations".

A view is emerging in the BJP that Modi and the lead campaigners should directly attack Kejriwal and highlight his party's "link" with the Congress instead of pretending that the new outfit isn't important enough to merit attention. "The Aam Aadmi Party may not win too many seats but it can damage the BJP by splitting the anti-Congress vote if Kejriwal's anti-Modi rhetoric works on the ground," a source said.

There is nothing wrong in taking aim at AAP or Kejriwal, or even trying to paint them as Congress surrogates. That's just politics as usual. But what is disingenuous is the pretense that his attacks on Modi are somehow unpatriotic.

In every democratic nation, candidates endure a bruising electoral process which serves an important vetting mechanism. Its adversarial nature ensures an airing of all arguments for and against each of the candidates. And no man or woman who aspires to be our prime minister can or should expect to be treated as inviolate. That Modi supporters demand this as their candidate's right -- and in the name of "democratic aspirations" -- says more about them than its does of the target of their criticism.


Don’t want to be involved in AP poll tie-up process: Venkaiah

Hyderabad: BJP spokesman and MP Prakash Javadekar is looking into the issue of party's electoral alliance in Andhra Pradesh and a statement would be made at an appropriate time, senior BJP leader M Venkaiah Naidu said here today.

"I don't give hourly status. (Prakash) Javadekar is looking into that. Let him respond as and when necessary; he will make a statement. I do not want to get involved into this," Venkaiah said, when asked about the status of talks between TDP and BJP.

The senior BJP leader, however, said he chose to stay away from the issue of BJP's alliances in Andhra Pradesh.

"What sort of a decision (on alliances)? I leave it to state party. I do not want to interfere in the process of seat-sharing, I don't want to interfere in the process of alignment of political parties or understanding with political parties in AP. Having served as party president, I do not want to get involved into these local discussions on alliances," he said.

The electoral math for parties in Andhra Pradesh appears complicated due to division of the state in carving out Telangana. According to reports, TDP, led by N Chandrababu Naidu is warming up to BJP, whereas TRS has already ended its honeymoon with Congress.

Sibal, Jogi, Azhar make Congress 3rd list, no Varanasi candidate yet

The Congress has released the names of over 50 candidates who will be contesting the upcoming elections. It has retained most of its incumbent MPs from Delhi and shifted former cricketer Mohammed Azharuddin to a new seat.

In the list announced following the central election committee meeting, the Congress announced that Ajay Maken, Sandeep Dikshit and Krishna Tirath were to remain its candidates from the constituencies that they presently represent. Union Minister Kapil Sibal will also contest from Chandni Chowk and will face off against Harsh Vardhan of the BJP and AAP's Ashutosh.

A notable inclusion in the list of candidates was Ajit Jogi, who had announced his 'retirement' from politics after the loss to the BJP in the Chhattisgarh assembly elections. Jogi, a one-time Chief Minister of the state, will contest for the Mahasamund seat in Chhattisgarh.

"I have decided to remain away from electoral politics for a year. I wanted to read, write, do contemplation and perform religious discourse and prayers," Jogi had said after the assembly elections. Seen participating in Holi festivities yesterday at the Congress office in Delhi, Jogi seems to have made amends with the party high command.

In the seat of Gurgaon, the Congress has decided to field Rao Dharampal, who takes the place of Rao Inderjit Singh, the incumbent MP who has switched sides to the BJP ahead of the poll. Dharampal has the unenviable challenge of also having to face AAP's Yogendra Yadav.

Former cricketer Mohammed Azharuddin, currently representing Moradabad in Uttar Pradesh, has been shifted to the seat of Sawai Madhopur in Rajasthan. Begum Noor Bano has already been announced as the candidate from the seat he vacated.

CNN-IBN reported that Azharuddin, who had sought to contest from another seat not located in Uttar Pradesh in this election, had met Sonia Gandhi and said he wouldn't contest unless he was given a seat in another state.

Rajasthan Congress party chief and minister Sachin Pilot also made the cut in the list and will be contesting from Ajmer. This comes even as reports initially indicated he may not be keen to contest from Rajasthan given the drubbing the party received in the assembly polls last year.

However, more than the candidates whose names were announced what was more notable were the names that weren't announced in today's list. Commonwealth Games scam accused Suresh Kalmadi has still to receive a ticket from the party and his wife is also to find mention in the Congress list. Adarsh scam accused and former Maharashtra chief minister Ashok Chavan is also still to find his name on the candidate list yet.

The party is also still to announce its candidate for the crucial seat of Varanasi, where the BJP's prime ministerial candidate Narendra Modi will be contesting. While the Aam Aadmi Party hasn't finalised that Arvind Kejriwal will contest from the seat, the Congress has only said that it will field a 'strong' candidate from the seat.

However, there is speculation that the party may field a relatively weaker candidate to give the AAP a clear shot at upsetting the BJP's star candidate. As this Firstpost piece notes:

With the emergence of Kejriwal, it is learnt that the non-BJP parties may arrive at an unofficial understanding to ensure that only one candidate – be it Kejriwal or any other – takes on Modi.

Ajay Rai, the previous candidate of the party, may be given the cold shoulder given that he is unlikely to yield to Mukhtar Ansari from the Qaumi Ekta Dal, who stood second during the previous election.

All eyes will now be on the next meeting of the Congress central election committee meeting next week to see if the notable exclusions so far are filled, and if so, by whom.


Bihar: 13 candidates file nominations

Patna: The Bihar Assembly speaker Uday Narayan Chaudhary and 12 other candidates today filed nomination papers in five parliamentary seats going to polls in the first phase on 10 April.

Chaudhary filed his nomination papers from Jamui (SC) parliamentary seat as the JD(U) candidate, while his RJD rival Sudhanshu Shekhar Bhaskar too submitted his nomination, according to the Chief Electoral Office (CEO) release.

In Sasaram (SC) Lok Sabha seat, JD(U) nominee KP Ramaiah, Chhedi Paswan of BJP and Surendra Ram, an Independent, filed their nomination papers, while Bagi Kumar Verma and Usha Sharan (Independent) submitted their nomination from Aurangabad parliamentary seat, it said.

JD(U) candidate Kaushal Yadav filed his nomination papers from Nawada Lok Sabha seat, while five candidates—Bhairav Dayal Singh (Independent), Jyoti Rashmi (Independent), Satya Narayan Singh (Independent), Sanjay Kewat (BSP) and Pradeep Kumar Joshi (Rashtriya Seva Dal)—submitted nomination for their candidature friom Karakat parliamentary seat, the release said.

Vijayakanth slams Jaya for not meeting PM in person

Udhgamandalam: DMDK President Vijayakanth today criticised Tamil Nadu Chief Minister Jayalalithaa for not meeting in person Prime Minister Manmohan Singh to discuss various problems being faced by the state.

Addressing an election rally here, Vijayakanth claimed the Prime Minister himself had told that Jayalalithaa had never met and discussed in person about the problems being faced by Tamil Nadu, when he met Singh some time back in Delhi.

Stating that he extended the support and joined NDA as its prime ministerial candidate Narendra Modi could give a "corruption-free" India, he said Jayalalithaa's dream of capturing power at Delhi would "remain a dream" only.

Vijayakanth alleged both DMK and AIADMK had failed in solving the problems of the people of Nilgiris district, like providing remunerative price for green tea leaves, including Badagas in Scheduled Tribe category and also an engineering college.

The actor-turned-politician also said his party will take all-out efforts and work hard to capture power in Tamil Nadu in the next assembly polls in 2016.

Jailtey defends Vajpayee govt releasing terrorists to end Kandahar crisis

Amritsar: BJP leader Arun Jailtey today defended Vajpayee government's releasing the three most wanted terrorists in return for the safety of passengers of the Indian Airlines plane hijacked to Kandahar in 1999, saying them lives of all Indians were "more precious" than the release of the terrorists.

He said in reply to a question that if NDA returns to power at the Centre its government would definitely ask Pakistan to hand over those accused of the plane hijack.

Jaitley's remarks about the plane hijack came in response to a question at a press confeference here how NDA government would handle national security when it had freed three hardcore terrorists in the plane hijack crisis in 1999.

Jaitley said would be no compromise with the national security.

The plane had been hijacked from Kathmandu and its last take-off point from India was Amritsar.

The hijack drama and the plane passenger hostage crisis had lasted for seven days before India freed three militants Mushtaq Ahmed Zargar, Ahmed Omar Saeed Sheikh and Maulana Masood Azhar who have since been implicated in other terrorist actions, including September 9/11, kidnap and murder of journalist Daniel Pearl and November 26, 2008 Mumbai terror attacks.

Jaitley accused the UPA government of having failed to give good governance and to tackle inflation, unemployment, strengthen national security and indulged in scams including coal blocks allocation, 2G telecom spectrum allocation and chopper purchase deal.

He claimed Narendra Modi has the capability to lead the nation to give good governance as Modi has vision due to his several years of track record as Chief Minister of Gujarat where he had "brought revolution in industry". Moreover, Modi would give new direction to Indian nation, Jaitley claimed.

The BJP leader said if NDA was voted to power and if the international border with Pakistan is opened, Amritsar would be turned into a trade hub.

He said if NDA forms the government at the Centre, Punjab Chief Minister Parkash Singh Badal would enjoy "considerable respect".

He claimed the masses of the country want a change of guard as they are "fed up" with the "poor governance" of UPA and voters have made up their mind to ensure NDA forms the next government.

Jayalalithaa case: SPP files plea in HC against cost on him

Bangalore: Special Public Prosecutor Bhavani Singh today moved the Karnataka High Court seeking quashing of a special court order, imposing a cost of one-day salary for two consecutive days on him in the disproportionate assets case against Tamil Nadu Chief Minister Jayalalithaa and three others.

Special Court Judge Michael D'Cunha had on March 14 imposed the cost amounting to Rs 60,000 to Rs 65,000 after Singh pleaded for adjournment on grounds of ill health.

The court had directed Singh on February 28 to resume arguments in the case in which Jayalalithaa had been charged with accumulating Rs 66 crore wealth disproportionate to known sources of income in 1991-95 when she was the Chief Minister.

In his plea before the High Court, he has maintained that the order granted by the special court was "arbitrary" and not according to law because he had submitted "genuine" medical cetificates before it, Singh said.

He had also stated that the court has not furnished proper reasons for rejecting the contents ingrained in medical certificates, Singh said.

The special court had observed that the conduct of Singh was unjustifiable after he abstained from appearing before it to resume the final arguments.

The court also had directed that the final arguments in Jayalalithaa case would commence from March 25 and for DMK General Secretary Anbazhagan to submit his written arguments.

The court also also gave Singh another chance to appear before the court on March 21 and resume the arguments.
